Oodalay, Inc. is a licensee of the TRUSTe Privacy Program. TRUSTe is an independent, non-profit organization whose mission is to enable individuals and organizations to establish trusting relationships based on respect for personal identity and information by promoting the use of fair information practices. This privacy statement covers the site www.oodalay.com. Because we want to demonstrate our commitment to our users' privacy, we have agreed to disclose our privacy practices and have them reviewed for compliance by TRUSTe. Information Collection Oodalay, Inc., 105 Serra Way # 341, Milpitas, CA 95035 ("Oodalay") is the sole owner of the information collected on Oodalay.com (the "Site"). Information Use Oodalay uses individual user information to facilitate the matching of users with appropriate content on and off the Site, to facilitate the matching of users with other users, facilitate communication between users on the Site, and for Oodalay to communicate directly with users (see below). User to user matching is based in substantial part on user profile information. Oodalay maintains aggregate user information (that is, information about Oodalay users as a group without tying information to specific users). This information includes population demographics, the relative popularity of Oodalay various forums and services, service sign-up rates, and the like. Oodalay uses this information to market the Site, to help sell advertising on the Site appropriate for the Oodalay user population, to develop services and content for the Site, and to improve the performance of the Site. 3. Cookies and Log Files Oodalay uses log files generated by software in response to user actions on the Site. The log file data include internet protocol (IP) addresses, browser type, internet service provider (ISP) identification, referring/exit pages, platform type, date/time stamp, and user "click" statistics. Oodalay uses the data to analyze trends, administer the Site, track users movement in the aggregate, and gather demographic information for aggregate use. Oodalay uses a tracking utility called Webtrends that analyzes log file data to provide Oodalay with general, non-user specific information about usage trends on the Site. Oodalay does not tie log file data to individual users profile information. From time to time we may use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user's hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions. We use cookies for navigation and session state control or log-in management. If users reject the cookie, they may still use our site. The only drawback to this is that the user may be limited in some areas of our site. Some of our business partners use cookies on our site (for example, advertisers). However, we have no access to or control over these cookies, once we have given permission for them to set cookies for advertising. 4. Communications from the Site Special Offers and Updates - Oodalay sends all new members a welcoming e-mail to verify password and username. Established members will occasionally receive information on products, services, special deals and the like. Users may opt-out of these services, except the welcoming e-mail and related service communications, which are required. Newsletter - If a user wishes to subscribe the Oodalay newsletter, Oodalay asks for contact information such as name and e-mail address. Users may opt-out of Oodalay the newsletter service at any time by editing account settings. Service Announcements - Occasionally, Oodalay may send out service related announcements, for example, when service is suspended for maintenance purposes. Customer Service - Oodalay communicates with users on a regular basis to provide requested services and to address issues relating to user accounts. These communications may be by postal mail, e-mail or phone, as appropriate. 4a. Communications through the Site Our site is designed with privacy in mind, and messaging through the site between users is permission based. Friends can invite friends by referring them to the site and can control their messaging. However, keep in mind that when you are posting information via the site whether through internal messaging, My Private Page™, posting a picture or external bulletin boards that others may be able to view your posts and you should be careful in posting personal information where it can be viewed by others. 5. Sharing of Information Oodalay does not share personal information with third parties except when required by law and/or when Oodalay has a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on Oodalay. In the event Oodalay goes through a business transition, such as a merger, being acquired by another company, or a sale of assets, ownership of users' personal information may be transferred. Users will be notified of a change of ownership or control of their personal information. Oodalay will notify users when, as a result of any business transition, users' personally identifiable information will be used in a manner substantively inconsistent with the terms of this Privacy Policy (as may be amended from time to time). Oodalay will notify users when their information is being collected by any third parties providing services in conjunction with Oodalay. Oodalay does this so users can make an informed choice as to whether or not they should proceed with services that require such third parties. 6. Links The Site contains links to other sites. Oodalay is not responsible for the privacy practices of such other sites. Oodalay encourages users to be aware when they leave the Site and to read the privacy statements of each and every site that collects personally identifiable information. This privacy statement applies solely to information collected by Oodalay. 7. Surveys From time-to-time, Oodalay may request information from users via surveys. Participation in these surveys is voluntary, and users may elect not to disclose this information. The requested information typically includes contact information such as email, and demographic information (such as zip code). Users may elect not to participate in any survey. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site. Users' personally identifiable information is not shared with third parties unless we give prior notice and choice. Though we may use an intermediary to conduct these surveys or contests, they may not use users' personally identifiable information for any secondary purposes. 8. Security Oodalay takes reasonable precaution to protect its users' information. Users' sensitive information submitted to Oodalay via the Site (e.g., via web-based forms) is encrypted for transmission using SSL encryption. The Oodalay servers are maintained in a limited access facility accessible only by authorized Oodalay personnel. 9. Correcting and Deleting Personal Information Users may correct, modify or otherwise update their personal information at any time. Users may accomplish this via the User Profile facility on the Site. Users may delete any optional user information at any time via the User Profile facility on the Site. 10.
